On 15 December 2023, UNIDROIT hosted a Panel Discussion on Contract Drafting in International Arbitration, organised by the Oslo Centre for Commercial Law with the support of UNIDROIT, AIA (Associazione Italiana Per l’Arbitrato) and the Milan Chamber of Arbitration, at the seat of UNIDROIT in Rome and online.
The panel discussion commenced with welcome remarks by UNIDROIT President Professor Maria Chiara Malaguti and was moderated by Professor Giuditta Cordero-Moss (Oslo University). The panel featured presentations by transactional lawyers who are regularly involved in the drafting and negotiation of international commercial contracts: Gianluca Buoro (General Counsel, Danieli Automation SpA), Filippo Innocenti (Counsel, Legance – Avvocati Associati), Edoardo Marcenaro (Head of Legal and Corporate Affairs, Enel Grids srl), Edgar Miller (Head of Development Legal Affairs, Enel Green power and Thermal Generation) and Professor Peter Arnt Nielsen (Copenhagen Business School).
The panel discussion provided concrete experience on the interpretation of contract clauses, focusing on the circumstances and the expectations of the contract drafters, and it forms part of the Pilot Empirical Project on Construction of Contracts in International Arbitration – Kluwer Arbitration Blog, which verifies whether international contracts are construed uniformly in arbitration, or whether legal traditions play a role even when the frame is international.
