On 11 November 2024, the International Conference on the 30th Anniversary of the UNIDROIT Principles of International Commercial Contracts (UPICC) and the General Principles of the Chinese Civil Code Contract Law convened in Shanghai, China. Jointly organised by UNIDROIT, the Shanghai International Arbitration Centre (SHIAC), Zhongnan University of Economics and Law (ZUEL), and the Civil Law Society of the China Law Society, the event welcomed over 200 legal experts and scholars in-person, along with an additional 30,000 virtual participants from around the world.
Attendees included representatives from UNIDROIT, the China Law Society, and leading universities in countries such as China, Italy, the United States, the United Kingdom, Japan, Brazil, and Vietnam. The conference marked a significant milestone for UPICC, examining its lasting influence on international commerce and law in China.
The conference commenced with opening remarks by Dr Yi Ma, Vice Chairman of SHIAC, and Prof Diyu Xu, Vice President of ZUEL. This was followed by a keynote address from UNIDROIT Secretary-General Prof Ignacio Tirado, who offered a comprehensive reflection on UPICC’s three-decade journey. Prof. Tirado examined its historical development, assessed its current impact on global commerce, and shared insights into the future potential of UPICC in adapting to emerging legal and economic challenges.
The conference featured five panels addressing various aspects of UPICC’s influence on global and national legal frameworks. Discussions included UPICC as a global instrument for enhancing international commercial practices, its role in cross-border trade dispute resolution, its interaction with the Chinese Civil Code Contract Law, and the challenges of UPICC in the context of globalisation. A dedicated panel also focused on recent developments within China’s judicial interpretations of the Contract Law, offering insights into the role UPICC might play in shaping China’s future legal landscape.
A highlight of the conference was the formal launch of the newly established UPICC International Arbitration Moot. From 2025, the UPICC International Arbitration Moot will provide a practical, pragmatic and real-world opportunity for law students around the world to enhance their understanding of the operation of UPICC in the context of commercial arbitration.
During the conference’s closing remarks, UNIDROIT Principal Legal Officer and Co-Director of Asian Transnational Law Centre Prof. Meiling Huang and SHIAC Deputy Secretary General Dr Guang Yang reiterated UPICC’s importance in global legal cooperation. The conference not only celebrated three decades of progress but also underscored UPICC’s role as a foundation for addressing future challenges in international commercial law.
