Between 18-20 November 2024, the UNIDROIT Working Group on Bank Insolvency met for its seventh session at the seat of UNIDROIT in Rome and online. The meeting was attended by 12 individual experts and over 60 representatives of the Working Group’s institutional observers, which include international and regional bodies and organisations, and banking supervisors, deposit insurers, and bank resolution authorities from all over the world.
The discussions focused on the feedback that had been received on the draft Legislative Guide on Bank Liquidation during the online consultation, which ran from 5 June to 11 October 2024. In addition, the Working Group discussed feedback on the draft Legislative Guide from Working Group participants, and it took note of the responses to a technical survey that the Secretariat had conducted on specific private law issues relating to bank liquidation proceedings.
At the end of the meeting, the Working Group provided the Drafting Committee with a mandate to update the draft Legislative Guide in line with the outcome of the discussions, with the support of the UNIDROIT Secretariat and the Financial Stability Institute.
The draft Legislative Guide on Bank Liquidation will then be finalised within the Working Group and submitted for adoption to the UNIDROIT Governing Council at its 104th session in May 2025.
