From 18 to 20 March 2024, the fifth session of the Working Group on Collaborative Legal Structures for Agricultural Enterprises (the “LSAE Project”) was held at UNIDROIT in Rome and online via Zoom.
The LSAE Project is a high-priority project jointly undertaken by UNIDROIT, the Food and Agricultural Organization of the United Nations (FAO) and the International Fund for Agricultural Development (IFAD). The purpose of this UNIDROIT/FAO/IFAD Project is to develop guidance on “collaborative legal structures for agricultural enterprises” to enhance sustainable agricultural development in value chains and contribute to the transformation of agri-food systems by: (i) improving access to viable markets, market resources and inclusive financial services; (ii) exploring innovation opportunities and risks offered by digitalisation, digitisation and digital platforms; (iii) addressing power imbalances and increasing participation in decision-making; and (iv) contemplating remedies for unbalanced commercial practices.
During the fifth session, the Working Group considered the issues raised in four Draft Discussion Papers regarding: (i) multiparty contracts; (ii) companies; (iii) cooperatives; and (iv) digital platforms. The Working Group also discussed the draft structure for the future instrument and a proposal for a glossary.
As a next step, during the intersessional period, the Subgroups will continue working on the draft discussion papers based on the recommendations received, and specific thematic meetings will be organised to advance the work on certain topics, such as digital agricultural platforms.
