UNIDROIT at International Colloquium on Capital Markets and Banking Unions, Law and the Courts

On 13-14 February 2025, UNIDROIT participated in the International Colloquium in Memoriam of Luís Silva Morais on “Capital Markets and Banking Unions, Law and the Courts: Challenges and Perspectives”. The two-day conference took place in Bologna and was jointly organised by the European Banking Institute, the University of Bologna, and Real Colegio de España in Bologna.

 

UNIDROIT President Maria Chiara Malaguti chaired a session on “Private-Law disputes in the Banking Union and Capital Markets Union: Challenges and Perspectives for an Effective Private Enforcement”. This session was moderated by UNIDROIT Governing Council member Stefania Bariatti (University of Milan) and featured a presentation by David Ramos Muñoz (University Carlos III of Madrid) on the role of private law in financial regulation, followed by a panel discussion.

UNIDROIT Secretary-General Ignacio Tirado chaired a session on “Corporate-law and insolvency-law disputes in Europe: Are specialised courts more responsive to effectiveness of EU law?” He spoke about the strong role for banking authorities in bank liquidation proceedings, with reference to the UNIDROIT Draft Legislative Guide on Bank Liquidation. Matthias Haentjens (University of Leiden), member of the UNIDROIT Working Group on Bank Insolvency, discussed key considerations for the design of institutional arrangements in bank liquidation proceedings, followed by a panel discussion about the role of courts in bank liquidation. UNIDROIT Senior Legal Officer Myrte Thijssen participated in a discussion of papers by members of the EBI Young Researchers Group.
