From 11 to 13 December 2024, the second session of the Working Group on Orphan Cultural Objects was held in a hybrid format at the seat of UNIDROIT in Rome. This project, part of UNIDROIT’s 2023–2025 Work Programme on private art collections, is being undertaken in collaboration with the University of Geneva Art-Law Center (ALC) and the Fondation Gandur pour l’Art (FGA).
The project aims to enhance legal certainty of works of art whose provenance is considered incomplete. The session commenced with the introduction of two new members: Ms Patty Gerstenblith, Distinguished Research Professor and Director of the Center for Art, Museum and Cultural Heritage Law at DePaul University College of Law, and Ms Zhang Jianhong, Professor of Archives at the Palace Museum.
Discussions during the session focused on the various types of orphan cultural objects and the preliminary draft guidelines structured around key components: Definition, Applicable Law, Provenance, Due Diligence, Burden of Proof, and the Procedure for “clearing” orphan objects.
